Directly attached padding is an interesting idea and would not be that hard if you attached a leather strip to the rear of the armour for the purposes of stitching.... Retro-fitting the strip will be annoying in the extreme though. In something like cased greaves would a layer of felt simply be glue...

I don't know how it works in the US but i'd go for a letter from a lawyer or an application at a small claims court.
